Fisher Phillips, one of the nation’s oldest and largest labor and employment law firms representing management, has an opportunity for an experienced Labor & Employment litigation attorney to join our team as Special Counsel in our Virtual Office, supporting a dedicated PEO client.
This non-partner-track role is ideal for an attorney who enjoys owning the day-to-day management of employment matters while delivering consistent, high-quality service to a sophisticated client and its insurance carrier. This position requires regular in-person participation in court proceedings, depositions, mediations, hearings, and other litigation-related events. Candidates must be comfortable with consistent in-person advocacy and client representation when circumstances require. Working closely with partners and internal teams, you will manage a high-volume docket from inception through resolution with no business development expectations, allowing you to focus exclusively on practicing law in a collaborative, service-driven environment. This is a dedicated, full-time role supporting a primary PEO client and requires consistent availability and long-term engagement.
You will handle administrative charges, attorney demand letters, and employment litigation matters, including EPLI-covered claims for a specific insurer. Responsibilities include developing case strategy; drafting and reviewing pleadings and motions; conducting and defending depositions; and representing clients in hearings, conferences, mediations, and trials. The role also includes supervising and mentoring attorneys and legal staff, coordinating closely with partners, associates, paralegals, and shared support teams, and maintaining proactive communication with the PEO client, its clients, and the insurance carrier. The practice focuses primarily on single-plaintiff matters, with potential involvement in class actions and PAGA cases. Regular travel within Northern California is expected.
Qualified candidates will have a JD from an ABA-accredited law school, seven or more years of employment law and litigation experience, and active bar membership in good standing. California admission is required. Preferred candidate will have experience working independently in a remote environment, experience with Professional Employer Organizations, and experience managing high-volume matters for a large client, and handling EPLI claims and carrier relationships.
This role offers remote flexibility; however, candidates must reside in Northern California and be readily available for ongoing in-person court appearances, depositions, and related proceedings.

The annual salary range for this position is $190,000 - $205,000, with actual base pay determined by factors such as the selected billable hours target.
